General terms and conditions (GTC) for the BioCV shop

 

1. Scope

1.1 These general terms and conditions (hereinafter "GTC") apply to all contracts between the customer and the BioCV shop (hereinafter "we" or "us"), concerning the sale of products in connection with the BioCV system.

1.2 Deviating or supplementary conditions of the customer do not apply unless we have expressly agreed to them in writing.

 

2. Conclusion of contract

2.1 The presentation of the products in the online shop does not represent a legally binding offer, but a non-binding invitation to place an order.

2.2 By submitting an order, the customer submits a binding offer to purchase the selected products.

2.3 The contract is concluded when we confirm the customer's order in writing or send the ordered products to the customer.

 

3. Prices and terms of payment

3.1 The prices quoted are in euros and do not include the statutory value added tax or any other taxes and duties that may be incurred.

3.2 The customer has the option of making payment by bank transfer or another means of payment accepted by us.

3.3 The purchase price is due immediately and payable without deduction. If the customer is in default of payment, we are entitled to demand interest on arrears in the legally permissible amount.

 

4. Delivery and Shipping

4.1 The products ordered will be delivered to the delivery address specified by the customer, unless otherwise agreed.

4.2 Delivery time may vary depending on product availability and destination. We will inform the customer of any delays in delivery.

4.3 The customer bears the shipping risk. Transport insurance can be taken out at the customer's request for an additional cost.

4.4 The delivery date can be either binding or non-binding. Specified delivery dates are generally non-binding unless they have been confirmed by us in writing as "binding". If a binding delivery date has been agreed, the delivery is deemed to be on time if the order is dispatched on the agreed date.

 

5. Right of Withdrawal

5.1 The customer has a statutory right of withdrawal. Further information on the right of cancellation, including the cancellation form, can be found in the separate cancellation policy, which is sent to the customer together with the order confirmation.

 

6. Warranty and Liability

6.1 We guarantee that the delivered products are free from material defects at the time of handover to the customer.

6.2 The customer must report any defects in writing immediately, but no later than two weeks after receipt of the products.

6.3 Our liability for damages that are not based on an intentional or grossly negligent breach of duty on our part is excluded to the extent permitted by law.

 

7. Privacy

7.1 We process the customer's personal data only within the framework of the applicable data protection regulations

8. Final Provisions

8.1 The law of the Federal Republic of Germany applies to the exclusion of the UN Sales Convention.

8.2 Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.

8.3 The place of performance and exclusive place of jurisdiction for all disputes arising from or in connection with these GTC is our registered office, provided the customer is a merchant, a legal entity under public law or a special fund under public law.
